Ekornes wins important copy case in Denmark

Sø- og Handelsretten (Court) in Copenhagen has today(21.04.2006) decided in favour of Ekornes in the copy case against the Danish chain Biva. The Court has decided that recliners sold by Biva are copies of Stressless recliners. The Court instructs Biva to stop all marketing and sales of the mentioned recliners and to pay Ekornes a compensation of DKK 650 000 in addition to covering the court costs.

Ekornes discovered the copy products back in 2003. Biva refused to pull the products from the market and Ekornes took Biva to court demanding stop of marketing and sales and compensation for the loss of profits and disturbances in the market.

Stressless enjoys a good reputation in the Danish market, and the Court points out that Biva, by selling the copy products, has violated the marketing laws and taken advantage of the strong reputation held by Stressless in the Danish market.

This case will be a very important reference case for any other copy case in Denmark or the rest of Scandinavia.

Ekornes has previously won copy cases in other countries where Stressless has been copied.

Biva is a Danish chain with 36 stores and with a focus on low cost furniture.
